​​​The U.S. Supreme Court will soon determine whether sexual orientation and gender identity are protected classes under Title VII of the federal Civil Rights Act of 1964 (Title VII). The Supreme Court case will consider if Title VII, which provides protection against sex discrimination, protects individuals from job discrimination based on sexual orientation and gender identity. Though sexual orientation and transgender status is not mentioned in Title VII, lower courts have ruled that gay and lesbian workers are entitled to protection from discrimination. The cases will be argued in the Fall, with decisions likely by June 2020, according to an article published by The Washington Post.

As well as advanced protections becoming a possibility via the Supreme Court hearing, legislation has recently been introduced in Congress that would add gender identity and sexual orientation to the classes protected from discrimination under the Fair Housing Act (FHA). Sexual orientation is not a protected class under current federal fair housing laws.
